Two Men Charged With Filming Teens Having Sex

McConnellsburg state police have accused two young Fulton County men of filming an underage male and female engaged in a sex act during a party that took place in May at a Todd Township residence.

Devon Alan Divens, 19, Harrisonville, and Blaze Chase Donelson, 18, McConnellsburg, have each been charged with two second-degree felony counts of photographing/videotaping/depicting on computer or filming sexual acts, one third-degree felony count of child pornography and a third-degree misdemeanor count of invasion of privacy. Divens also faces a third-degree felony charge of dissemination of photographs, videotapes, computer depictions and films and a second third-degree misdemeanor charge of invasion of privacy – transmission of image by phone, email, Internet, etc.

According to court documents, the charges stem from an incident that occurred on May 25, at a supposed party held at a private residence on Brooklyn Drive, McConnellsburg, during which two minors were filmed having sex, allegedly without their knowledge.

In their affidavit of probable cause, state police stated that a 14-year old female arrived around 7 p.m. at the party where everyone was swimming, eating pizza, and having a campfire. The female minor said she felt pressured to be with a certain 15- year-old boy, who was also at the party. The girl further stated she and the boy eventually went into a bedroom together alone, and she performed oral sex on him.

It wasn’t until June 5 that the girl’s sister informed her about the video recording of the May 25 sexual encounter, and she went to the police the next day. She told police she did not know she was being recorded, court documents state, nor had she seen the video.

On June 11, state police interviewed Divens on the porch of his home, where, according to court documents, he said that he and Donelson went to said party but left around 9-9:30 p.m. to retrieve shorts. When they returned, he saw the two minors, a boy and a girl, walk to a bedroom in the house. Divens said that another girl told them the two were having sex.

After further conversation, Divens admitted that he, Donelson, and another juvenile male recorded the sexual encounter in a 10 to 15 second clip. He admitted to using his cellphone, and then sending the video to two friends of the boy involved, according to court documents.

He also told police that “you couldn’t see any private parts, just their bodies.”

On July 10, state police interviewed Donelson at the Mc- Connellsburg station. He confirmed that he and Divens left the party to get shorts, and that when they came back a short time later, they saw the girl and boy walk into a bedroom. Donelson told police that after a while everyone decided to go check on what the girl and boy were doing, and that he had gone inside to get his phone charger.

According to the court documents, Donelson said that Divens recorded the pair on his cellphone. Police asked Donelson if he recorded the pair himself, and he said he did, but that he used another boy’s phone because his phone was dead. When asked for specifics on what App was used, both Donelson and Divens admitted to recording the encounter on Snapchat.

Donelson told the police that he and the boy whose phone he used watched the video then deleted it.

Preliminary hearings for Divens and Donelson are set for Sept. 10. Both are free on $15,000 unsecured bail, according to court records.
