Pa. Man Cleared In Newborn's Death Sues Troopers
UNIONTOWN, Pa. (AP) – A southwestern Pennsylvania man is suing the state police for false arrest in the death of his former sister-inlaw's newborn baby in June 2000.
Warren Bircher Sr. was acquitted in August 2010 of charges he killed and helped conceal the death of Sara Sue Hawk's newborn daughter. Hawk, of North Union Township, pleaded guilty to thirddegree murder in the baby's death and testified against Bircher.
The Pennsylvania State Police don't comment on litigation.
As part of her plea bargain, Hawk testified against Bircher – who was her brother in-law when the baby was born – claiming he fathered the child then killed the baby to conceal the affair.
Bircher spent 19 months in jail before a Fayette County jury acquitted him in the death of the baby found wrapped in plastic bags inside a backpack in a Uniontown creek.
