Call Of The Criminal Trial List Held

Judge Carol L. Van Horn of the 39th Judicial District of the Fulton/Franklin County Court of Common Pleas presided over call of the criminal trial list held on Tuesday, April 10, at the Fulton County Courthouse.

 Loren Andrew Barclay appeared for call of the list last week on charges of theft by unlawful taking, agricultural vandalism and agricultural trespassing. An amendment was made to the charges adding attempted theft by unlawful taking to which Barclay entered a guilty plea. He will be sentenced on May 15.

 Jason Stephen Crist was granted a continuance until the July 10 call of the list. Crist is charged by rangers at Cowans Gap State Park with aggravated assault, resisting arrest, violation of commonwealth rules and public drunkenness.

 William John Decyk III was given a continuance until the July 10 call of the criminal trial list. Decyk faces charges of possession of a small amount of marijuana and the use or possession of drug paraphernalia as well as four summary offenses.

 A trial has been set for April 26 and 27 for codefendants Marc Steven Dorce and Richard Muliek Kearney. Both men face a multitude of charges in two cases, including harassment, false imprisonment, simple assault, harassment and recklessly endangering another person.

Two additional cases involving Kearney have been continued to the July 10 call of the list. Charges against Kearney in those incidents involve burglary, simple assault, recklessly endangering another person, harassment and criminal mischief.

 Harold Lewis Fix Jr. appeared in court on two counts of driving under the influence of alcohol and two summary offenses. Fix pleaded guilty to drunk driving and will be sentenced on April 19.

 Elwood G. Gallagher appeared for call of the list on three counts of driving under the influence, which included alcohol and controlled substances, and two summary offenses. Gallagher pleaded guilty to driving under the influence of alcohol and will be sentenced on July 12.

 James Lynn Junkins appeared in court on one count each of retaliation against a witness of victim, simple assault and harassment. Junkins entered a plea of guilty to retaliation and will be sentenced on June 12. Additional charges from a case dating back to 2011 were dismissed.

In addition, Junkins pleaded guilty to burglary in another 2011 case. He will be sentenced on June 12 in this case as well.

 Aaron Steven Karle was granted a continuance to the July 10 call of the criminal trial list. He is charged with access-device fraud and theft by unlawful taking.

 Douglas Alan Kerlin is scheduled for trial on June 6 on charges of unsworn falsification to authorities and false reports.

 Christopher Nathan Koons appeared in court on two counts of driving under the influence and one summary offense. Koons’ trial was set for June 19.

 Jonathan D. Musselman appeared for call of the list on one count each of burglary, criminal trespass and theft by unlawful taking. Musselman entered a guilty plea to burglary and will be sentenced on May 22.

 Two cases involving Robert Stanley Painter were continued until the July 10 call of the criminal trial list. Charges pending against Painter include escape, theft by unlawful taking, receiving stolen property, mischief, aggravated and simple assault and recklessly endangering another person.

 A trial date of July 6 has been set for Charles Mearl Riley, who is charged with delivery of a controlled substance, possession of a controlled substance, the use or possession of drug paraphernalia, driving under the influence of a controlled substance and three summary offenses.

 Joshua Wayne Robinson appeared in court last Tuesday on charges of rape by forcible compulsion, rape of a child, involuntary deviate sexual intercourse, statutory sexual assault and indecent assault. Robinson’s trial has been scheduled for June 21.

 Joseph Anthony Scavone was granted a continuance until the July 10 call of the list on one count of retail theft.

 Edward Scott was given a continuance until April 17. Scott is charged with aggravated assault, simple assault and harassment.

 A case involving Sarah Lynn Sipes was continued until July 10 call of the criminal trial list. Sipes is accused of criminal attempt-murder, aggravated assault, terroristic threats, simple assault and recklessly endangering another person.

 Timothy Lee Spriggs appeared in court last Tuesday and entered a plea of guilty to delivery of a controlled substance. He will be sentenced on June 26. An additional case that includes charges of possession of a controlled substance and the use or possession of drug paraphernalia has been dismissed.

 A bench warrant was issued for the arrest of Sterling Hadley Summers, who failed to appear on charges of possession of a small amount of marijuana, the use or possession of drug paraphernalia and one summary offense.

 Kenneth R. Swanger was granted a continuance until July 10 on one count each of theft by unlawful taking and receiving stolen property.

 David Andrew Tyer appeared in court on one count of driving under the influence and two summary offenses. He was granted a continuance until the July 10 call of the criminal trial list.
