Garry Shoemaker sentenced for indecent assault

A McConnellsburg man will complete two years probation after having entered a guilty plea to the indecent assault of a local woman.

Forty-six-year-old Garry Allen Shoemaker of 47 Hillside Estates stood before Fulton County Court of Common Pleas Judge Angela Krom on Tuesday for sentencing in connection with an incident that occurred at a McConnellsburg Borough residence along Lincoln Way West during the early morning hours of April 4, 2011.

Defense attorney David Keller informed the court that since his arrest last June, Shoemaker has accepted responsibility for the contact that occurred without the woman’s consent. In addition to fully cooperating with state police investigators and officials from the county Probation Department, Keller said his client has also refrained from using marijuana and has drastically reduced his alcohol consumption.

Shoemaker confirmed that he has cut back on drinking and stated, “Anyone can stop. It’s all in your brain.” He also announced he regretted having any involvement with the victim and will refrain from having any contact with her in the future.

Judge Krom noted she was “initially troubled” when she saw the allegations that emerged after Shoemaker attended a birthday party for the victim’s son. The judge was also troubled when heard about the plea agreement that had been reached in Fulton County Central Court. However, based on evidentiary issues, she said she felt this was indeed an appropriate plea.

In addition to completing two years probation, Shoemaker will also complete 50 hours of community service and any sex offender treatment deemed necessary. Restitution is owed to the victim as well as Fulton County Medical Center, where a sexual assault evidence kit was prepared by staff.
