Homicide Trial Slated For Pa. Man In Fatal Hit-Run

CHAMBERSBURG, Pa. (AP) – Trial is scheduled to open Tuesday for a south- central Pennsylvania man charged with homicide in a fatal hit and run outside a tavern almost a year ago.

Authorities in Franklin County allege that 42-year-old Gerald Buterbaugh of Hustontown deliberately hit 32-year-old Dale Henry of Burnt Cabins, Fulton County, outside the Hillside Tavern in Metal Township on May 31.

Police said Buterbaugh told investigators that there had been a fight outside and he was trying to leave and tried to “push (Henry) off the road and scare him.’’

Defense attorney Christopher Sheffield told the (Chambersburg) Public Opinion that his client didn’t intentionally hit Henry and didn’t know he had been seriously injured.

Prosecutors have said the case will be prosecuted as firstdegree murder. Buterbaugh remains in Franklin County Jail without bail.
