McFadden Pleads Guilty To Assault Case

A McConnellsburg man will be sentenced next month after recently entering a guilty plea to multiple counts of the corruption of minors and indecent assault of a teenage girl.

Thirty-four-year-old Timothy Marlin McFadden Jr. of 189 Strait Way Drive, McConnellsburg, appeared before Judge Carol L. Van Horn on February 2 in the Fulton County Court of Common Pleas on three counts of involuntary deviate sexual intercourse; 18 counts each of unlawful contact with a minor, corruption of minors, indecent assault; 11 counts of statutory sexual assault; and four counts of aggravated indecent assault.

McFadden appeared with defense attorney Steve Rice of Gettysburg and waived arraignment proceedings in order to enter a plea of guilty to three counts each of the corruption of minors and indecent assault of a person less than 16 years of age. All counts are listed as misdemeanor one and two.

McFadden was charged in late 2009 when the father of a 15- year-old girl stepped forward on November 20 to reveal to Pennsylvania State Police investigators he found sexually explicit messages on his daughter’s phone after she left for school one morning. The alleged messages between the girl and Mc- Fadden requested naked photos of the juvenile and made references to the need to take a pregnancy test to determine if she was pregnant to McFadden.

Meanwhile, the teenage girl reportedly admitted to investigator Trooper Blaine Henderson of the McConnellsburg barracks that she and McFadden had sexual intercourse up to 13 times between November 6 and November 15. The acts took place in several locations, including at an Ayr Township farm, inside Mc- Fadden’s Dodge truck while parked at the Big Cove Tannery fish hatchery, inside the truck while parked in a wooded area, along a dirt road near Bull Run Road in Licking Creek Township and at McFadden’s residence.
