Foor, Dubree Enter Pleas

Two men facing charges of rape in separate incidents that occurred as far back as June of 2008 appeared in the Fulton County Court of Common Pleas last week to officially enter their pleas.

Kevin Duane Foor Sr. of 174 Fox Street, Defiance, entered a guilty plea to one count of rape by forcible compulsion before Judge Douglas W. Herman last Tuesday during mandatory arraignment. Foor has been represented in court proceedings by defense attorney Shawn Cohen and will be sentenced on October 6 following a presentence investigation by the Fulton County Probation Department.

DNA evidence found on three pieces of latex glove located at and in the vicinity of the crime scene linked Foor to the June 16, 2008, episode that occurred not far from the intersection of Enid and Wells Valley roads.

Even though Foor would not cooperate with Pennsylvania State Police and submit to a polygraph test or be interviewed by Trooper Richard Cutchall, he did provide police investigators with a DNA sample that ultimately led to his apprehension. The results of the DNA comparison revealed one piece of a latex glove found at the scene allegedly contained a mixture of the victim's and Foor's DNA. Two additional pieces of glove located had either Foor's or the victim's DNA, fellow investigator Trooper Angela Roher revealed in the affidavit of probable cause.

The 12:30 p.m. assault occurred along Enid Road in Wells Township while an area woman was taking her daily walk. During the course of the sexual assault, the victim told the suspect her husband knew how long her walk took, and he would come looking for her. After being told to get up, the victim walked home and alerted her husband.

Meanwhile, Stephen William Dubree Jr. appeared before Judge Herman as well last Tuesday on one count each of rape of a child, statutory sexual assault, attempted involuntary deviate sexual intercourse with a child; two counts each of attempted rape of a child, attempted statutory sexual assault, aggravated indecent assault of a child, aggravated indecent assault, indecent exposure; and 20 counts of indecent assault.

Dubree of 68 Hillside Estates, McConnellsburg, pleaded not guilty to all allegations he raped a 12-year-old girl and exposed himself to and assaulted the girl's younger sister at his Todd Township residence.

Charging documents filed by Trooper Roher of the Mc- Connellsburg barracks show the alleged activity between the 39- year-old native of South Carolina and the area girls began on January 1, 2009, and ended with the most recent incident on May 2, 2009. The girls had reportedly spent the night at Dubree's residence many times, according to the affidavit of probable cause.

The eldest of the two girls confided to state police she told Dubree, "I'm 12 and you're 40. You practically molested me." The affidavit further adds that Dubree asked her not to tell anyone.

Dubree's trial has been tentatively scheduled for the July 27 term of court.
