Area Man Arraigned On Statutory Sexual Assault

A Needmore area man recently pleaded not guilty during mandatory arraignment to a variety of felony and misdemeanor assault charges, including statutory, aggravated and indecent assault for his alleged involvement with a 14-year-old girl.

Nineteen-year-old Derek James Lininger of 9606 Sipes Mill Road was arranged before Fulton County Court of Common Pleas Judge Douglas W. Herman on five counts each of statutory sexual assault, aggravated indecent assault, indecent assault and involuntary deviate sexual intercourse with a person less than 16 years of age.

Lininger pled not guilty to the charges that stem from incidents that occurred between December 2008 and January 2009. His trial has tentatively been scheduled for the July 27 term of court.

In an affidavit of probable cause filed in late February through Magisterial District Judge Carol Jean Johnson, Pennsylvania State Police Trooper James Lupey, formerly of the McConnellsburg substation, said he interviewed both the victim and Lininger. The duo stated they had been "dating" or "seeing" one another after meeting at the home of the victim's cousin in November 2008.
