Judge Walsh, Judge Herman Preside Over October Court Sessions

STAFF REPORT

Judges Richard J. Walsh and Douglas W. Herman of the 39th Judicial District of the Fulton County Court of Common Pleas presided over court sessions held at the Fulton County Courthouse on October 7 and 14.

Michael Allan Clouser appeared with legal counsel for arraignment on charges of driving under the influence. Clouser entered a not-guilty plea, and he is scheduled for a trial during the January 2009 term of court.

Nathan Russell Sheffield failed to appear in court on October 7. A bench warrant was issued for Sheffield's arrest.

Michael Norman Atkins appeared with his attorney and waived arraignment proceedings held on charges of delivery and possession. Atkins pled not guilty, and his trial will be conducted during the January 2009 court term.

During a probation/parole-violation hearing, Jonathan Carl Stallman was sentenced to between three and 23 months in the Franklin County Prison and 80 hours of community service. He is also eligible for work release.

Tony Lynn Fox Jr. appeared without counsel for a probation/paroleviolation hearing. Fox's participation in the Accelerated Rehabilitative Disposition (ARD) program was terminated. Fox is slated to appear in court during the January 2009 trial term.

Ronald Lee Robinson appeared in court with legal counsel and had his bail reduced following certain conditions.

Shawn Michael Younker appeared in court for a hearing held on a motion to reduce bail.

Steven Edward Burdette appeared pro-se and waived arraignment on charges of simple assault and harassment. Burdette entered a not-guilty plea. His trial will be conducted during the January 26, 2009, term of court.

Joshua Philip Crouse, who faces charges of robbery, criminal conspiracy and theft, entered a motion to have his trial continued until the January term of court.

Gary Lynn Hockenberry appeared in court on October 14 on charges of the use or possession of drug paraphernalia. Hockenberry pleaded not-guilty, and his trial will be held during the January 26 term of court.

Dwayne Alan Lewis appeared with legal counsel and entered a notguilty plea to charges of indecent assault. Lewis will reappear in court during the January 26 court term for a trial.

Philip Lee Collins appeared with his attorney and waived arraignment proceedings on charges of driving under the influence. Collins pled guilty and will be sentenced on December 9 following a pre-sentence investigation by the Fulton County Probation Department.

Nena M. Meck appeared with her attorney and pled guilty to theft by unlawful taking. Meck was ordered to complete 18 months probation.

Antonio McNear appeared in court on charges of driving under the influence and was sentenced to 12 months probation.

Eric Michael Kelly appeared with his attorney for sentencing on driving under the influence and related charges. Kelly will complete between 30 days and six months in the Franklin County Prison for drunk-driving and an additional 15 days to 17 months for related charges. Additional sentences of 24 months and $100 in fines were also imposed.

Prentice Hays Spriggs failed to appear in court on charges of receiving stolen property. A written court order was issued in the matter.
