Pa. Man Charged With Theft For Bank Deposit Error
ALTOONA, Pa. (AP) - An Altoona man is being charged with theft after not returning more than $280,000 mistakenly deposited into his bank account.
First Commonwealth Bank has also filed a civil suit against 57-yearold Herbert Starbird, who spent more than half of $280,276 he found in his account. The bank wants Starbird to return the money.
Altoona detective Scott Koehle says Starbird was charged Tuesday with theft and receiving stolen property.
Starbird's attorney Thomas Dickey says his client spent the money after the bank told him the Oct. 23, 2007 deposit was not a mistake.
The bank says in its civil suit that Starbird never contacted the bank and was never told the money belonged to him.
Dickey says Starbird will plead not guilty to the criminal charges.
