INVITATION FOR BIDS

Notice is hereby given that sealed bids will be received by the Fulton County Commissioners’ Office, Fulton County Neighborhood Services Building, 116 West Market Street, McConnellsburg, PA 17233-1020, for the Parking and Drainage Improvements to the Fulton County Food Basket Inc. Facility, 100 Woodside Drive, McConnellsburg, PA 17233 – Contract No. 10- 100015.00 on Tuesday, April 6, 2010, until 11:00 a.m. prevailing time at which time and place said Bids will be opened and read aloud.

Contract documents may be examined at the office of Dennis E. Black Engineering Inc. located at 2400 Philadelphia Avenue, Chambersburg, PA 17201, or at the Fulton County Commissioners’ Office at the Fulton County Neighborhood Services Building, 116 West Market Street, Mc- Connellsburg, PA 17233-1020 and can be obtained at either location.

The project will consist of the expansion, regrading, paving and striping the existing parking area, installation of a stormwater sump and steel pipe guardrail and demolition and removal of an existing outside wooden staircase.

Bid security in an amount no less than 10 percent of the amount of the bid will be required in the form of cash, a certified or cashier’s check (drawn upon a bank authorized to do business in this Commonwealth), or satisfactory bid bond issued by a corporate surety authorized to do business in the Commonwealth of Pennsylvania made payable to or naming as Obligee “Fulton County”.

A Performance and Payment Bond in an amount equal to 100 percent of the amount of the contract and issued by a corporate surety authorized to do business in the Commonwealth of Pennsylvania will be required to be furnished by the successful bidder.

Any contract awarded under this Invitation for Bids is expected to be funded in whole or in part by a grant/or loan from CDBG, therefore, Davis Bacon Wage Determination will apply. Neither the United States nor any of its departments, agencies, or employees is or will be party to this Invitation for Bids or any resultant contract.

In addition to the Equal Employment requirements of Executive Order 11246 regarding discrimination, the Contractor must establish a 3 percent goal for female participation and a 5 percent goal for minority participation in his aggregate onsite construction work force for contracts in excess of $10,000. Section 3 requires that the Contractor must utilize, to the greatest extent feasible, local area businesses, trainers, employees, and low-moderate income persons within the general trade area.

In accordance with Executive Orders 11625, 12138, and the County of Fulton’s MBE plan, the Contractor must utilize, to the greatest extent feasible, minority and/or women-owned business concerns. Bidders are hereby notified that MBE/WBE firms will be afforded full opportunity to bid without discrimination.

A Pre-Bid Conference for prospective bidders will be held at the Fulton County Food Basket Inc. Facility, 100 Woodside Drive, McConnellsburg, PA 17233 on Tuesday, March 23, 2010, at 11:00 a.m. Attendance is not mandatory, but recommended.

The Fulton County Commissioners reserve the right to reject any or all bids and to waive any or all defects, errors, omissions, irregularities or informalities in any bid.

Bids may be held by the Fulton County Commissioners for up to 60 days from the date of opening for the purpose of reviewing the bids and investigating the qualifications of bidders prior to awarding the contract.

Awards shall be made only to responsible bidders that possess the potential ability to perform successfully under the terms and conditions of this procurement. Consideration shall be given to such matters as bidder integrity, compliance with public policy, record of past performance and financial and technical resources when determining responsibility.
